agree and acknowledge that I am entering into an agreement with Next Level Gym. LLC for fitness, wellness, personal training, and/or exercise services, whether engaged in exercise with a trainer or individually, group, including but not limited to fitness, dance, exercise wellness, weight lifting, and/or training machines (hereinafter referred to as “Program”). In consideration thereof, I acknowledge and agree that fitness, wellness, personal training, exercise, use of weights and/or machines is a vigorous activity and could be potentially hazardous to my health. I further certify that I have consulted with my physician and my physician has released me to participate in personal training, exercise activities, weight lifting or training on machines.
I further certify and acknowledge that that I am voluntarily participating in the Program with knowledge of the danger involved. I hereby voluntarily agree to accept and assume all risks of personal injury by participation in this Program. Further, I release and forever discharge, and agree not to sue Next Level Gym, LLC, its officers, board of directors, members, manager, and or employees, including any volunteers and outside resource persons who participate as leaders or volunteers in the Program, from any and all manner of claims, causes of action, or liability which I may have now or at any time in the future against Next Level Gym, LLC, its officers, employees, members, managers and/or board of directors, arising out of or pertaining to any injury, loss, damage, or harm of any kind which may result or happen to me while participating in the Program, including any injury, loss, damage, harm or death which may result from the negligence of any employee, officers, members, managers, and/or board of directors.
I further certify and acknowledge that Next Level Gym, LLC its employees, officers, members, manager, and/or board of directors do not assume any liability or responsibility arising out of providing or failing to provide any professional health care services.
I further certify and acknowledge that Next Level Gym, LLC its employees, officers, members, manager, and/or board of directors do not assume any liability or responsibility arising out of advising, providing or selling any type of dietary supplements, diet plans, dieting information, weight reduction plans or information, or prescription medications, including but not limited to herbs, dietary pills, energy supplements, steroids, human growth hormones, or weight loss or gain substances. FURTHER I ACKNOWLEDGE AND AGREE THAT IT IS ILLEGAL AND AGAINST THE LAWS OF THE UNITED STATES OF AMERICA AND THE LAWS OF THE STATE OF OKLAHOMA TO GIVE, BARGAIN, TRADE, CONVEY OR SELL BY ANY MEANS ANY TYPE OF ANABOLIC STEROID. THIS ACTIVITY IS STRICTLY PROHIBITED WITHIN AND AROUND THIS FACILITY.
I further certify and acknowledge that Next Level Gym, LLC its employees, officers, members, managers, and/or board of directors are not responsible for my personal property that I may bring into the facility. I hereby hold Next Level Gym, LLC, harmless from any liability for the theft, loss, and/or destruction of any personal property.
This Release and Waiver of Liability is an addition to and does not revoke or modify any other agreement or release, which I may execute which may be related to the Program.
